By accessing or using any product or service offered by Habilesoft India Private Limited ("HabileSoft", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

These terms apply to all visitors, users, and others who access the service. We reserve the right to update these terms at any time, with changes effective upon posting.

02Description of Services

HabileSoft provides AI-powered software products and services, including but not limited to EVA (Enterprise Voice AI), Kova (Agent & LLM Marketplace), and Sales IQ (AI Lead Intelligence). The nature, features, and availability of services may change at our discretion.

03User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use at info@habilesoft.com.
• We reserve the right to suspend or terminate accounts that violate these terms.

04Acceptable Use

You agree not to use our services to:

• Violate any applicable law or regulation.
• Transmit any unsolicited, harmful, or deceptive content.
• Attempt to gain unauthorised access to any system or network.
• Reverse-engineer, decompile, or disassemble any part of our software.
• Resell, sublicense, or commercially exploit our services without written permission.
• Use our AI products to generate illegal, harmful, or malicious content.

05Intellectual Property

All content, designs, code, logos, and trademarks on HabileSoft platforms are the exclusive property of Habilesoft India Private Limited or its licensors. Nothing in these terms grants you a right to use our intellectual property without prior written consent.

You retain ownership of any content you submit through our services, but grant us a non-exclusive, royalty-free licence to use it to operate and improve the service.

06Payments & Subscriptions

• Paid plans are billed in advance on a recurring basis (monthly or annual).
• All fees are non-refundable unless required by applicable law.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Failure to pay may result in suspension or termination of access.

07Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

08Limitation of Liability

To the fullest extent permitted by law, HabileSoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including loss of profits, data, or goodwill - arising from your use of or inability to use our services.

09Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India.
